1. Acceptance of Terms

By accessing or using PromptsPanda (“Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance.

2. Description of Service

PromptsPanda provides a curated library of AI image-generation prompts and related content. We may offer free and paid (Pro) access. We reserve the right to modify, suspend, or discontinue any part of the Service with or without notice.

3. Account & Registration

You may need to create an account to access certain features. You are responsible for keeping your credentials secure and for all activity under your account. You must provide accurate information and notify us of any unauthorized use.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You may not: use the Service to violate any law or third-party rights; attempt to gain unauthorized access to our systems or other accounts; scrape, copy, or redistribute content in bulk without permission; use the Service to generate or distribute harmful, illegal, or offensive content; or interfere with the operation of the Service. We may suspend or terminate accounts that violate these terms.

5. Intellectual Property

The Service, including its design, text, graphics, and compilation of prompts (where we hold rights), is owned by PromptsPanda or its licensors. Your use does not grant you ownership. You may use prompts from the library in accordance with your subscription (e.g., personal use, or commercial use if permitted under Pro). Individual prompts may have their own attribution or license requirements; you are responsible for complying with those.

6. Subscriptions & Payments

Paid subscriptions (e.g., Pro) are billed according to the plan you choose. Fees are non-refundable unless otherwise required by law or stated in our refund policy. We may change pricing with notice. You may cancel your subscription in accordance with our cancellation policy; access continues until the end of the current billing period.

7. Disclaimers

The Service is provided “as is” and “as available.” We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Prompts and AI-generated content are for inspiration; we do not guarantee specific outputs from third-party AI tools. You use the Service at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, PromptsPanda and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or use, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim, or one hundred dollars, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless PromptsPanda and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

10. Governing Law & Disputes

These terms are governed by the laws of the jurisdiction in which PromptsPanda operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction, unless otherwise required by applicable law.
